Background
The Ministry of Land and Rural Resettlement (MLRR) has developed project: Support to the Ministry of Lands and Rural Resettlement 2014 to 2016 Action Plan. The main objective of the project is to assist the MLRR accelerate the rehabilitation of the land sector as a prerequisite for recovery and development of agriculture and other land based economic sectors. The project is supported with resources from the UNDP and European Union from 2014 to 2017. The UNDP and EU are fully committed to support the critical elements of this project. The main objective of the project is to capacitate the MLRR accelerate the rehabilitation of the land sector as a prerequisite for recovery and development of agriculture and other land based economic sectors. The project will also capacitate the Zimbabwe Land Commission (ZLC), which is pivotal to land in the country. The project will bring together partners to support the MLRR, the ZLC and the Department of the Surveyor General (DSG) to deliver on their mandates with regards the land reform. This will be catalytic in addressing the critical areas that will work towards the finalization of the outstanding issues on valuation, compensation, conflict resolution, base mapping and surveying of the resettled areas. The proposed  interventions will ensure that MLRR, the ZLC and the DSG have the capacity to monitor and track the production and productivity on agricultural land anchored on the Zimbabwe Agenda for Socio-Economic Transformation (ZIM-ASSET), the MDG commitments and other national performance indicators.

Project Outputs are as follows:

  • Output 1: Updated database on inventories of acquired farms;
  • Output 2: Consensus based compensation mechanism in place;
  • Output 3: Adequate survey control network established;
  • Output 4: Surveyed A2 farm units and updated land information database;
  • Output 5: Land Information System within the Ministry strengthened, effectively managed and coordinated;
  • Output 6: Dispute Resolution Framework Developed;
  • Output 7: Land Tenure Policy Is Reviewed and Implemented;
  • Output 8: Zimbabwe Land Commission is capacitated and functional;

Project context:

The Zimbabwe Land Commission was established in July 2016 in terms of Section 296 of the Zimbabwe Constitution (Amendment No.20), and its functions are outlined in section 297 as follows:

Ensure accountability, fairness and transparency in the administration of agricultural land that is vested in the state.

To conduct periodic audits of agricultural land.

To make recommendations to Government regarding:

  • The acquisition of private land for public purposes;
  • Equitable access to and holding and occupation of agricultural land, in particular:the elimination of all forms of unfair discrimination, particularly gender discrimination; the enforcement of any law restricting the amount of agricultural land that may be held by any person or household;
  • Land usage and the size of agricultural land holdings;
  • The simplification of the acquisition and transfer of rights in land;
  • Systems of land tenure;
  • Fair compensation payable under any law for agricultural land and improvements that have been compulsorily acquired;
  • Aallocations and alienation of agricultural land.

The ZLC is an entirely new entity and its needs must be assessed. The ZLC will comprise of nine Commissioners and supporting Secretariat. As well as this it will be located at its own building. Thus its needs assessment must include: human capacity, infrastructure, Information and communications technologies (ICT) as well as the financial requirements for it to meet its mandate.

It is in this context that UNDP wishes to engage consultant(s) to undertake a comprehensive needs assessment and requirements for the ZLC. In undertaking this assignment the consultant(s) will carry out extensive consultations with the ZLC, the MLRR, other government ministries, existing commissions, local authorities, farmers and farer organisations, the broader private sector, donors and development partners.

Duties and Responsibilities
Scope of work:

Objective:
The objective of the assignment is to undertake a comprehensive needs assessment of the newly established ZLC. The needs assessment will cover all the aspects needed for a new ZLC.

Specific activities of the assignment:

The following are the key activities that the consultant will undertake:

  • Review the necessary documents that pertain to the establishment of the ZLC as well as other policy documents on the related commissions;
  • Undertake detailed consultations with the ZLC Commissioners on their needs;
  • Undertake detailed consultations with the members of the ZLC Secretariat;
  • Undertake consultations with the MLRR in relation to the ZLC;
  • Undertake consultations with other existing Commissions within the country;
  • Undertake consultations with the Public Service Commission;
  • Undertake consultations with key stakeholders in the public and private sectors;
  • Provide information on how Commissions in other countries operate;
  • In determining the needs assessment the consultant shall take due cognisance of the needs for the Commissioners and the Secretariat especially the following: ICT (hardware and software and the requisite infrastructure) human capacity development, development of land audit instruments, development and interpretation of the various regulations and legislation, client charters, budget and finance management, codes of conduct, study tours and visits, conditions of service conducting meetings and reporting procedures.

Expected outputs/deliverables:

All deliverables such as reports, plans and other artefacts should be delivered to UNDP for onward transmission to the ZLC and the MLRR for acceptance and/or approvals in order to reach the planned milestones and proceed to the next stages.

Inception Report: Within one week of signing the contract the consultant shall present an Inception Report detailing the Assignment Work Plan. The work plan shall indicate the clear timelines, a detailed approach and methodology as well as the indicative structure of the final report;

An Interim Report: The Interim Report shall be in the following parts:

  • Comprising the documents reviewed, stakeholders views, identification of issues and challenges and any concerns raised during the various consultations;
  • Analysis of other national and international Commissions of similar nature;
  • Analysis of possible options of the needs of the ZLC;
  • Specific recommendations on the needs, which if met will capacitate the ZLC.

A stakeholders workshop to commend on the finding of the needs assessment, draft recommendations and validation of the Interim Report;

Final Report that incorporates all the comments from stakeholders, the ZLC, MLRR, UNDP and workshop participants.

Management and supervision:

  • The consultant(s) will be supervised by the Permanent Secretary of MLRR and the Chairperson of the ZLC;
  • Administrative and strategic support and guidance will be provided by UNDP;
  • Through the Permanent Secretary of MLRR and Chairperson of the ZLC the consultant will ensure that the key stakeholders are regularly consulted and updated on the progress of development of the assignment.

Timeframe and duration of the assignment:
The duration of the assignment is 40 working days commencing January 2017 over a period of three months.

The Project

Ongoing uncertainty and instability in South Sudan underscores the fragile justice system that has thus far failed to provide effective legal remedies to the most vulnerable segments of South Sudan’s population, particularly women and youth in marginalized rural communities across the country. Compounding the supply-side challenges to the establishment of a vibrant and healthy justice system is the lack of capacity amongst rule of law actors to effectively carry out their duties in a manner that respects human rights and the needs of citizens. Additionally, the absence of information, trust, and confidence in the justice sector has limited the ability of the citizenry to demand effective legal remedies, and a lack of capacity in civil society has hindered their ability to fill the critical gaps in the current justice system, placing the responsibility in the hands of limited interventions by international actors.

To address these issues, the Access Partnership Consortium (APC), consisting of Search for Common Ground (SFCG), in partnership with the International Development Law Organization (IDLO) and the Initiative for Peace Communication Association (IPCA), is proposing a two year project with the following overall goal: To improve access to justice services that provide legal remedies to rural and marginalized citizens in five South Sudanese counties.

This overall goal will be achieved through a three-pronged approach that will: (1) increase demand for effective justice services, (2) improve supply of quality legal remedies for the most marginalized populations, and (3) produce community-rooted research leading to policy reform to ensure nationwide impact.

The project’s theory of change is:

If marginalized citizens have increased access to an improved justice sector, and this access is complemented by interconnected media and civil society support, then the foundation will be laid for a more functional and equitable justice sector, and improved peaceful coexistence at the community level.

The project has three activity streams:

Activity Stream 1: Improved demand for legitimate and effective justice mechanisms that address the needs of the most vulnerable populations.

Objective 1: Citizens are aware of their legal rights and duties.

· Result 1: The APC generates an increased demand for legitimate justice services through increased community knowledge of and familiarity with their legal and human rights and the judicial system.

· Activities: Radio magazine and drama production; participatory theater and community dialogue forums; public info campaign; and justice newsletter.

Objective 2: Citizens, including indigent individuals accused of serious crimes, are provided with legal aid.

· Result 2: Legal aid clinics, advocates, and paralegals have increased capacity to offer pro-bono legal aid services increasing citizen access to legal aid services.

· Activities: Legal aid clinics and the provision of pro-bono legal aid services; assessment of mobile and special courts; support to legal aid advocacy and paralegals; assessment of the referral system; and legal education.

Objective 3: CSOs more effectively facilitating access to justice, with an eye towards project sustainability.

· Result 3: Increased program sustainability through improved capacity and increased engagement in justice system activities by target CSOs.

· Activities: CSO capacity building; technical trainings; and rural justice fund.

Activity Stream 2: Improved supply of quality legal remedies that meet the unique needs and rights of marginalized populations.

Objective 4: Rule of law actors, including police, prosecutors, and prisons, are provided with increased support to carry out their core functions.

· Result 4: Increased trust in rule of law actors through improvement in their ability to carry out their duties in line with human rights standards.

· Activities: Police and prison officer trainings; training curriculum; prosecutor trainings; gender accountability modules; rule of law actor coordination forums; and an assessment of future law activities.

Objective 5: Justice service providers, including customary law courts and statutory courts, are providing citizens (including women and youth) with effective legal remedies.

· Result 5: Improvement in the performance of local justice providers -particularly with regards to the needs of women and youth- leading to increased engagement with justice mechanisms.

· Activities: Statutory and customary law trainings; mentoring program for justice actors; provision of legal resources; community legal meetings.

Activity Stream 3: Community-rooted research leading to policy reform.

Objective 6: Develop a law and policy package on legal aid.

· Result 6: Increased capacity of the Directorate of Legal Aid and Human Rights to execute its functions related to legal aid provisions.

· Activities: Legal expert to support Directorate; assessment of barriers to access to justice; support to grassroots legal aid efforts.

Objective 7: Local and national level policy makers and donors have access to knowledge gained from research on rural justice issues and project implementation to strengthen reforms to legislative and policy framework.

· Result 7: Increased access to authentic information to improve access to justice.

· Activity: Justice and conflict research; integrated research

2. Objectives of Study

SFCG seeks a consultant to conduct a baseline study for this project. The objectives of the study are as follows:

  1. Investigate the intersection between justice and conflict in South Sudan (and relevant gaps and opportunities)
  2. Conduct a needs assessment to determine the capacities of the following groups in supporting access to justice:
  3. Justice sector
  4. Civil Society Organizations (CSOs)
  5. Police and prison officers
  6. Assess the project Objectives, Indicators and Theory of Change (TOC), and potential to carry out Objectives 4-7 in the scope of the project.
  7. Conduct a risk assessment in order to ensure “Do No Harm” and conflict sensitivity are respected in the project.

3. Geographic Locations

Together, the donor and implementing partners will determine the five project locationsbased on a set of criteria including preexisting APC presence, previous experience with INL programming, ongoing access to justice interventions, need for project activities, potential for sustainability, marginalization, and potential for access (conflict and security). Special consideration will be given to Protection of Civilians sites (PoCs), such as in UN House and Bor, where displaced populations oftentimes lack access to fair and unbiased justice mechanisms.

The baseline will be used to determine final project locations. Potential locations include[1]:

  • Juba County
  • Bor
  • Mingkaman
  • Torit
  • Rumbek
  • Nimule

The baseline will be conducted in three of the five locations selected for the project (depending on the budget). Of these three there must be urban and rural population representation.

4. Baseline Questions

The evaluation questions will be developed by the external consultant on the basis of the questions below, specifically seeking to identify the following in target communities:

Conflict and Justice Contextual Assessment

 
  • What long-term and recent developments have affected conflict dynamics and access to justice?
  • What is the state of work supporting ‘access to justice’ in South Sudan? What are the current approaches being taken? What are the gaps (and entry points to address them) and opportunities for improved systemic response?
  • What are the key drivers and triggers of conflict? What unifiers and dividers shape conflict?
  • How do existing conflicts affect access to justice?
  • What does ‘peaceful coexistence’ mean to citizens?
  • What mechanisms currently support peaceful coexistence?

Assessing Access to Justice

  • How do citizens define and understand access to justice?
  • Which citizens/demographic groups experience marginalization in communities, and does it affect their access to justice? What are the barriers to accessing to justice?
  • Capacities and Service Provision
  • What are the capacities of the justice sector in providing services to all?
  • What role do the media, civil society, and security sectors play in the delivery of justice, and what are their capacities in supporting access to justice? Assess the current reach and relevance of media and civil society justice campaigns or programs.
  • To what extent do media, civil society, and justice sectors coordinate to improve and expand justice services?

Theory of Change and Program Design

  • Considering the current status of project indicators, objectives and theory of change, are there recommendations for adaptations to improve the potential impact of the project?

Risk Assessment

  • What are the contextual and project-related risks that require monitoring throughout the project?
  • What can the project do to assure it is conflict sensitive and respects “Do No Harm” principles?

5. Methodology

The baseline will apply a mixed-methods approach consisting of a literature review[2], quantitative survey, as well as qualitative methods (Focus Group Discussions (FGDs) and Key Informant Interviews (KIIs)). The consultant will be responsible for finalizing the literature review, designing the final methodology, developing tools, training of enumerators, data analysis, and drafting of the report. The Project Team will review all tools as well as collect qualitative data in at least three locations (in consultation and coordination with the consultant). The baseline/needs assessment will include questions developed with theSouth Sudan Law Society and other entities to look at the intersection of justice and conflict in the country.

Deliverables

SFCG expects the following deliverables from the external consultant:

  • A baseline plan (inception report) detailing a proposed methodology, tools, calendar and written evaluation tools for a baseline study;
  • Training of enumerators;
  • Supervision and participation in data collection;
  • Oversight of the data coding process;
  • Submission of the databases to SFCG;
  • PowerPoint presentation of findings;
  • Analysis of the data collected and production of a draft evaluation report in English, for review by SFCG staff and partners;
  • A Final Report in English (40 pages max in length, excluding appendices) that consists of (unless otherwise agreed upon with SFCG):
  • Table of contents
  • Abbreviations
  • Executive summary of methodology, limitations, key findings and recommendations
  • Background information (project specifics)
  • Methodology: Objectives, data collection and analysis and limitations of the study
  • Research findings, analysis, with associated data presented (should be structured around the main objectives/evaluation criteria and should cover all indicators)
  • Indicator table showing all baseline indicators
  • Appendices, which include detailed research instruments, list of interviewees, terms of references and evaluator(s) brief biography.

Logistical Support

The consultant(s) will be responsible for organizing their own logistics for data collection (vehicles, fuel, and drivers), and this must be budgeted into the study. SFCG South Sudan will provide support in arranging the logistics. At least one SFCG staff member will be available to support qualitative data collection for this study.

In addition, SFCG and partners will share the following elements with the external consultant: Background materials including the project proposal and logframe, M&E plan, etc.

8. Requirements of consultant

  • The following skills and experience are expected by SFCG for our evaluator for this project:
  • Proficiency in English and Arabic (written and spoken);
  • More than 5 years of experience in project evaluation, including collecting data in interviews, surveys and focus groups;
  • Experience in conflict analysis and working with justice and civil society sectors;
  • Experience working with international organizations;
  • Experience conducting quantitative surveys and analysis;
  • Evaluation methods and data collection skills;
  • Familiarity and experience with South Sudan contextual challenges.

In addition, the consultant is required to respect the following Ethical Principles[3]:

  • Comprehensive and systematic inquiry: Consultant should make the most of the existing information and full range of stakeholders available at the time of the review. Consultant should conduct systematic, data-based inquiries. He or she should communicate his or her methods and approaches accurately and in sufficient detail to allow others to understand, interpret and critique his or her work. He or she should make clear the limitations of the review and its results.
  • Competence: Consultant should possess the abilities and skills and experience appropriate to undertake the tasks proposed and should practice within the limits of his or her professional training and competence.
  • Honesty and integrity: Consultant should be transparent with the contractor/constituent about: any conflict of interest, any change made in the negotiated project plan and the reasons why those changes were made, any risk that certain procedures or activities produce misleading review information.
  • Respect for people: Consultant respect the security, dignity and self-worth of respondents, program participants. Consultant has the responsibility to be sensitive to and respect differences amongst participants in culture, religion, gender, disability, age and ethnicity.

OXFAM, CARE, ADRA, DRC, World Vision, COOPI and ACF have formed the Somalia Resilience Program (SomReP) consortium which aims to improve household and community resilience in populations affected by crises through targeted livelihood interventions. The program targets multiple donors for a large scale Somalia wide coordinated approach to resilience that compliments large scale UN initiatives for resilience. A technical team comprised of pastoral, peri-urban and agricultural livelihood technical specialists will bring together best-practice approaches of the participating agencies under a joint design, monitoring and evaluation framework. World Vision International will host the grant management function for the consortium, led by a Chief of Party to lead the program development and inception process.

The SomReP Deputy Chief of Party (DCoP) will support the Chief of Party (CoP) in resource acquisition management and results reporting. In the absence of the CoP, assume management responsibility for the program. The DCoP will contribute to strategic vision for SomReP and WV Somalia’s goals to build resilience in Somalia.

He/she will lead the fundraising, proposal development, sub grant award & management, reporting (financial and programmatic) functions of the Consortium, and will directly supervise the Programs staff, Finance staff and the Adminstrative support function, and the timely and quality reporting to all SomReP donors.

He/She will provide the bulk of external representation and communication with donors, and SomReP steering committee with close coordination with and support from the Chief of Party. The position will provide management to the SomReP financial function to facilitate program activities, ensure accurate financial reporting and stewardship of donor resources.

KEY RESPONSIBILITIES:

Background
The Ministry of Land and Rural Resettlement (MLRR) has developed project: Support to the Ministry of Lands and Rural Resettlement 2014 to 2016 Action Plan. The main objective of the project is to assist the MLRR accelerate the rehabilitation of the land sector as a prerequisite for recovery and development of agriculture and other land based economic sectors.  The project is supported with resources from the UNDP and European Union from 2014 to 2016. The UNDP and EU are fully committed to support the critical elements of this project.  The main objective of the project is to capacitate the MLRR accelerate the rehabilitation of the land sector as a prerequisite for recovery and development of agriculture and other land based economic sectors.  The project will also support the establishment of the Zimbabwe Land Commission (ZLC), which is pivotal on the land in the country. The project will bring together partners to support the MLRR which includes the DSG to deliver on their mandates with regards the land reform. This will be catalytic in addressing the critical areas that will work towards the finalization of the outstanding issues on valuation, compensation, conflict resolution, base mapping and surveying of the resettled areas. The proposed interventions will ensure that MLRR has the capacity to monitor and track the production and productivity on agricultural land anchored on the Zimbabwe Agenda for Socio-Economic Transformation (ZIM-ASSET), the MDG commitments and other national performance indicators. Project Outputs as follows:

  • Output 1: Updated database on inventories of acquired farms;
  • Output 2: Consensus based compensation mechanism in place;
  • Output 3: Adequate survey control network established;
  • Output 4:  Surveyed A2 farm units and updated land information database;
  • Output 5:  Land Information System within the Ministry strengthened, effectively managed and coordinated;
  • Output 6: Dispute Resolution Framework Developed;
  • Output 7: Land Tenure Policy Is Reviewed and Implemented;
  • Output 8: Zimbabwe Land Commission is capacitated and functional;
  • Output 9: Project management.

Context of the Assignment:

Output 4 of the project requires that a digital land database is developed. This component of the project will be driven by the Department of the Surveyor General (DSG).

The Department  of the Surveyor General (DSG) is mandated to oversee the survey of all state land and examine and approve all cadastral surveys and provide custodianship of all the records pertaining to such surveys in terms of the Land Survey Act[Chapter 20:12]. It is therefore prudent for the department to develop applications that manage all land transactions.  In Zimbabwe, numerous parcels are being surveyed at a rapid rate, owing to the Land Reform and National Housing Delivery Programs, and the existing cadastral information system, which is largely manual, is failing to cope with the corresponding influx of surveys. This resultant failure to cope negatively impacts on the DSG’s land information delivery capabilities. Further the land surveyor sector is also modernising its operations with the use of digital technologies.

The Land Transaction System (LTS) an attribute database run on Microsoft Access 97 and the Watermark system, which was used for capturing the graphics/spatial and established to compliment the LTS were commissioned in 1998. The development of the two systems marked the beginning of the automation of all land transactions and digital storage of available cadastral data. No upgrades were performed over the years and both systems collapsed in 2007. The failure of both systems meant that the movement of survey records cannot be easily tracked, making it difficult for the DSG office and its clients to access information on surveyed properties as well as performing searches prior to carrying out a survey.

The Cadastral Index Mapping Project which aimed to convert all the 1:2 500 cadastral compilations from their current analogue format to digital format was also suspended years ago because of resource constraints.

In the last few years, demand for cadastral data in digital format has risen dramatically. The DSG is failing to meet this demand. This has resulted in many private surveyors developing their own data sets to unknown standards and selling this to desperate clients who need this data for their GIS applications.

The development of an automated and up-to-date cadastral database is thus long overdue. There is need to develop a robust cadastral information database which feeds into a national multi-purpose cadastre upon which all property transactions, planning and decision making are based. The development of an electronic cadastre (e-cadastre) will also assist the Government of Zimbabwe to provide on-line services to its citizens, business and public sector administrations within the e-Government framework.

It is in this context that the UNDP wishes to engage a consultant(s) on behalf of the MLRR to develop a digital land database. In undertaking the assignment the consultant will conduct extensive consultations with the DSG, the land survey sector (public and private) other relevant government ministries/departments. 

Duties and Responsibilities
Scope of work

The project will entail the automation of descriptive data and the LTS on one hand and the automation of spatial data on the other. The automation of spatial data will involve converting all  Cadastral Index Maps (compilation sheets) to digital format. This component of automation of Cadastral Index Maps will complement a new LTS and brought together the two will form a robust and easy-to-maintain system that is also capable of accommodating the lodgement of cadastral records in digital format (digital lodgement).  The new system to be developed should also be able to accommodate transactions related to title registration activities (i.e. deductions). In addition, it is desirous to develop a system that can be integrated or linked to other databases, not only within the DSG and MLRR  such as the geodetic and topographic databases but to other external land administration/GIS databases (e.g. in the Deeds Registry and Municipalities).

Specific Activities:

The following are the key activities that the consultant is expected to undertake:

  • Review of the current system cadastre database/system at the DSG;
  • Assess the user needs of a digital cadastre database;
  • Undertake systems re-designing and re-engineering as appropriate;
  • Development of a prototype and  evaluation;
  • System testing and implementation;
  • Training of users (both internal and external);
  • Development of a support system.

Expected outputs/deliverables:

All deliverables such as reports, plans and other artefacts should be delivered to UNDP for onward transmission to the MLRR for acceptance and/or approval in order to reach the planned milestones and proceed to the next stages. The consultant(s) will therefore be expected to deliver the following:

Inception Report: Within one week of signing the contract the consultant(s) shall present an Inception Report detailing the Assignment Work Plan. The work plan shall indicate in clear terms the detailed approach and methodology, the list of identified key stakeholders to be consulted, the timelines. The report will also indicate the envisaged structure of the final report.

An Interim Report:  The Interim Report shall be in the following parts:

  • Comprising the documents reviewed, stakeholders views, identification of issues, concerns regarding the current cadastre database at the DSG;
  • Analysis of the user needs for digital cadastre  database;
  • The draft on the analysis the current cadastre database and the recommended  systems re-engineering and redesign;
  • The analysis of the development of prototype cadastre database and its initial evaluation;
  • The systems testing and implementation.

Final draft report: The final draft report that incorporates all comments and evaluation of the digital cadastre database form the MLRR, the UNDP and other stakeholders.

Timeframe of Assignment:

The duration of the assignment is 50 working days commencing January 2017 over a period of five months.

Required Skills and Experience
Education:

  • At least a B. Sc. Honours Degree in Geoinformatics/Geographic Information Systems (GIS);
  • A Masters degree in the related field will be a distinct advantage.

Experience:

  • At least five years proven experience in the development of Information Systems and Spatial Databases;
  • Technical expertise regarding data models, database design development, data mining and segmentation techniques;
  • Ability to write appropriate interfaces (e.g. Microsoft Excel) for data entry and ensure data quality and security;
  • Previous experience in developing data management;
  • Excellent verbal and written communication in English.

Language:

  • Fluent in written and spoken English.

Evaluation criteria
The Consultant will be evaluated based on qualifications and the years of experience, as outlined in the qualifications/requirements section of the ToR. In addition, the Consultant will also be evaluated on the following methodology:

  • Technical Criteria weight: 70%;
  • Financial Criteria weight: 30%.

The award of the contract shall be made to the Consultant whose offer has been evaluated and determined as: Responsive/compliant/acceptable; and having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the Terms of Reference.
